Agreement to Terms
By accessing or using the services provided by FMA Fontana Masonry, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services or website.
Services Provided
FMA Fontana Masonry provides professional masonry services including but not limited to brick repair, chimney rebuilding, stone installation, paver work, and related construction services. All services are subject to written estimates and contracts that outline the specific scope of work, materials, costs, and timelines.
We reserve the right to refuse service to anyone for any reason at any time. Service availability may be limited by weather conditions, material availability, permit requirements, and scheduling constraints.
Estimates and Pricing
All estimates provided are based on visual inspection and the information you provide. Final pricing may change if unforeseen conditions are discovered during work, additional services are requested, or material costs change significantly. We will notify you of any price changes and obtain your approval before proceeding with additional work.
Estimates are valid for 30 days from the date of issue. After this period, pricing may be subject to adjustment based on current material and labor costs.
Payment Terms
Payment terms will be outlined in your written contract or estimate. We typically require a deposit before work begins and final payment upon completion. We accept cash, checks, and major credit cards. Payment is due in full as specified in your contract unless other arrangements have been made in writing.
Late payments may be subject to interest charges as permitted by California law. If your account is sent to collections due to non-payment, you will be responsible for all collection costs including attorney fees.
Cancellation and Rescheduling
If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellations made after materials have been ordered or work has begun may result in charges for materials purchased and labor already performed. We will work with you to minimize these costs whenever possible.
FMA Fontana Masonry reserves the right to reschedule work due to weather conditions, equipment failure, material delays, or other circumstances beyond our control. We will notify you as soon as possible and work to minimize delays.
Warranties and Guarantees
We stand behind our workmanship and offer warranties on our services as outlined in your contract. Warranty coverage varies by project type and may be limited by factors such as normal wear and tear, acts of nature, or improper maintenance. Material warranties are provided by the manufacturer and are separate from our labor warranties.
To maintain warranty coverage, you must follow any maintenance recommendations we provide and address any issues promptly. Neglected maintenance or unauthorized repairs may void warranty coverage.
Property Access and Safety
You agree to provide safe and reasonable access to the work area and to secure any pets during work hours. We will take reasonable precautions to protect your property, but you should remove or protect any valuable items near the work area. You are responsible for maintaining clear access routes and ensuring that our equipment and vehicles can safely reach the work site.
During active work periods, the work area may be unsafe. Please keep children, pets, and others away from the work site for their safety.
Permits and Inspections
When required, we will obtain necessary permits for your project. Permit costs are typically included in your estimate unless otherwise noted. You are responsible for providing accurate property information and any homeowner association approvals that may be required.
All work is subject to local building code inspections as required by law. We will coordinate these inspections and address any issues identified by building officials.
Limitation of Liability
FMA Fontana Masonry's liability for any claim related to our services is limited to the amount paid for the specific services that are the subject of the claim. We are not liable for indirect, incidental, or consequential damages including but not limited to lost profits, lost business opportunities, or other economic losses.
Our insurance coverage provides protection for property damage and injuries that may occur during work. Claims must be reported promptly to allow proper investigation and processing.
Intellectual Property
All content on our website including text, graphics, logos, and images is the property of FMA Fontana Masonry and is protected by copyright laws. You may not copy, reproduce, or distribute our content without written permission.
Privacy and Data Collection
We collect and use your personal information as described in our Privacy Policy. By using our services, you consent to our collection and use of this information. We do not sell your personal information to third parties.
Dispute Resolution
If a dispute arises regarding our services, we encourage you to contact us directly to resolve the issue. Most concerns can be addressed through open communication. If we cannot reach a resolution, disputes will be governed by California law and resolved in the appropriate courts of San Bernardino County.
